1. Age Requirements & Eligibility

You must be at least 18 years of age to use Athwan. By creating an account, subscribing, or using the service, you represent and warrant that you are 18 or older and have the legal capacity to enter into a binding contract.

Athwan is not directed at children. Persons under the age of 18 are strictly prohibited from using the service.

2. Acceptable Use Policy (AUP)

Athwan is a private AI biographer intended for personal, family, and reflective journaling. You agree not to use the service to:

• Submit, generate, or store any material that is illegal, unlawful, or promotes illegal activities.
• Submit any material depicting explicit violence, non-consensual sexual content, or Child Sexual Abuse Material (CSAM). Violations of this will be immediately reported to the appropriate authorities.
• Harass, abuse, threaten, or defame any person.
• Attempt to engineer, "jailbreak," or maliciously prompt the underlying AI models to bypass safety filters.

3. Fair Usage Policy (FUP)

Athwan provides "Unlimited" features (such as text memories, voice notes, and photos) for active Premium subscribers. These features are intended for personal, non-commercial use only.

To ensure system stability and prevent abuse (such as botting or large-scale data storage not related to personal journaling), we enforce a Fair Usage Policy. This includes reasonable monthly caps (e.g., 1,000 photos per month) which are designed to be well above the needs of any human user. Accounts that consistently exceed these limits or engage in commercial activity may be reviewed, limited, or terminated at our sole discretion.

4. Account Termination

We reserve the right to suspend or terminate your account and permanent access to the service at any time, with or without notice, if we reasonably determine that you have violated these Terms of Service or our Acceptable Use Policy.

4. Disclaimers & Liability

Athwan utilizes generative AI. Please review our AI & Content Disclaimer for limitations regarding AI accuracy and the lack of medical or psychological advice. To the maximum extent permitted by law, Athwan is provided "as is" and we disclaim all liability for any direct or indirect damages arising from your use of the service.

5. Subscriptions, Cancellations, and Refunds

Athwan is a subscription-based service. By subscribing, you agree to recurring billing based on the term selected (monthly or annually) until you cancel.

• Cancellations: You may cancel your subscription at any time by texting "Billing" to the service and following the provided link, or by visiting the Stripe Customer Portal. Upon cancellation, your subscription and access to the service will be terminated immediately.
• No Refunds: Due to the immediate upfront costs of generating AI outputs and mathematical vectors, all payments are final and non-refundable. We do not offer prorated refunds for partially used billing periods or immediate cancellations.

6. Referral Program

Athwan offers a referral program to reward users for growing our community. By participating, you agree to the following:

• Referrer Reward: For every friend who joins Athwan using your unique referral link, you may be eligible to receive a referral credit applied to your account balance or Stripe customer balance. The specific amount and eligibility criteria for these credits are determined by Athwan and may change from time to time.
• Friend's Reward: Friends who join via a referral link may be eligible for a promotional reward or discount upon choosing to upgrade to a paid subscription, as current at the time of their upgrade.
• Stripe Sync: For active subscribers, referral credits are typically synced with your Stripe account. For new subscribers, accrued credits will be applied to your first qualifying invoice upon upgrade.
• Anti-Abuse: Self-referrals, fraudulent accounts, or "spamming" referral links are strictly prohibited. We reserve the right to void any credits and terminate accounts found to be gaming the referral system. Athwan reserves the right to modify, suspend, or terminate the referral program at any time.
